  1. Registration

You may access areas of the Voices of IW Site that require registration by becoming a registered member and creating an account with us.  You agree to be responsible for maintaining the confidentiality of your passwords or other account identifiers which you choose and all activities that occur under your account.

By registering on the Voices of IW Site, you agree that:

(i) your account and password are personal to you and may not be used by anyone else to access the Voices of IW Site;

(ii) you will not do anything which would assist anyone who is not a registered user to gain access to any registration area of the Voices of IW Site; and

(iii) you will not create registration accounts for the purpose of abusing the functionality of the site, or other users; nor will you seek to pass yourself off as another user.

You agree to notify us immediately if you become aware of any unauthorized use of your password or account identifiers by others.

  1. Termination of registration

If you no longer wish to have a registered account, you may terminate your account by sending an email to voices@iw.edu.  If you no longer accept these terms and conditions, or any future modification to these terms and conditions, you must cease using the Voices of IW Site.  Continued use of the Voices of IW Site indicates your continued acceptance of these terms and conditions.

If for any reason we believe that you have not complied with these terms and conditions, we may, at our sole discretion, cancel your access to the registration areas of the Voices of IW Site immediately and without prior notice.  We may terminate your registered account, at our sole discretion, by emailing you at the address you have registered stating that the agreement has terminated.

  1. Use of material appearing on the Voices of IW Site

Your use of the Voices of IW Site is for your own personal and non-commercial use only.  The Voices of IW Site is owned and operated by Iowa Wesleyan University and its affiliates.  Except with respect to User Submissions (as defined below), all of the content featured or displayed the Voices of IW Site, including, but not limited to, text, graphics, photographs, images, moving images, sound, illustrations, software, and any other content (collectively, the “Content”), is owned by Iowa Wesleyan University.  All elements of the Voices of IW Site, including but not limited to the general design and the Content, are protected by trade dress, copyright, moral rights, trademark, and other laws relating to intellectual property rights.  The Voices of IW Site may only be used for the intended purpose for which such Site is being made available.  Except as may be otherwise indicated in specific documents within the Site, you are authorized to view, play, print, and download documents, audio, and video found on our Site for personal, informational, and noncommercial purposes only.  Except with respect to your User Submissions (as defined below), you may not modify any of the materials and you may not copy, distribute, transmit, display, perform, reproduce, publish, license, create derivative works from, transfer, or sell any information or work contained on the Site.  Except as permitted under applicable copyright laws, you are responsible for obtaining permission before reusing any copyrighted material that is available on the Site.  For purposes of these terms, the use of any such material on any other website or networked computer environment is prohibited.  You shall comply with all applicable domestic and international laws, statutes, ordinances, and regulations regarding your use of the Site.  The Site, the Content, and all related rights shall remain the exclusive property of Iowa Wesleyan University unless otherwise expressly agreed in writing.

  1. Disclaimer of liability

To the extent permitted by law, we do not accept any responsibility for any statement in the Voices of IW Content.  Nothing in the Voices of IW Content is provided for any specific purpose or at the request of any particular person.  For the avoidance of confusion, we will not be liable for any loss caused as a result of your doing, or not doing, anything as a result of viewing, reading, or listening to the Voices of IW Content or any part of it.  You can access other sites via links from the Voices of IW Site.  These sites are not under our control and we are not responsible in any way for any of their contents.

Although we will do our best to provide constant, uninterrupted access to the Voices of IW Site, we do not guarantee this. We accept no responsibility or liability for any interruption or delay.

  1. User submissions

The Voices of IW Site allows users to submit their original writing and other content (e.g. comments on content, art, photography, videography, sound captures, participation in communities) that they have created for consideration in connection with the Voices of IW Site and any related programs (“User Submissions”). User Submissions remain the intellectual property of the user and you retain all ownership rights in your User Submissions. In order for Iowa Wesleyan University to make the User Submissions available on the Voices of IW Site, you agree that, by posting your User Submissions on the Voices of IW Site, you grant to Iowa Wesleyan University an unconditional, irrevocable, non-exclusive, royalty-free, fully transferable, perpetual worldwide license to use, publish and/or transmit, and to authorize third parties to use, publish and/or transmit your content in any format and on any platform, either now known or hereinafter invented.  This license also grants Iowa Wesleyan University the right to sublicense your User Submissions to other users of the Voices of IW Site to permit their use of those User Submissions in the manner in which the Voices of IW Site from time to time permits User Submissions to be used (e.g., sharing, reviewing, and commenting on User Submissions). 

The above license granted by you in User Submissions will terminate within a commercially reasonable time after you remove or delete your User Submissions from the Voices of IW Site.  We may refuse or remove User Submissions for any reason and without notice.  All User Submissions are deemed non-confidential and Iowa Wesleyan University shall be under no obligation to maintain the confidentiality of any information, in whatever form, contained in any User Submission.  Notwithstanding anything to the contrary herein, Iowa Wesleyan University shall not modify the terms of this paragraph without providing notice to users.  By submitting any User Submissions, you consent to the following rules: 

  • User Submissions must not infringe on the copyright, trademark, patent, or other intellectual property rights of any third party.  If your User Submission is not your original work, you must obtain all necessary permissions from any persons who contributed to or otherwise may control rights in all or part of the User Submission to submit the User Submission in accordance with these Terms. 
  • User Submissions must not violate a third party’s right to privacy or publicity.  You must obtain all necessary permissions from any individuals identified in or implicated by your User Submission, including those shown in photographic content, and, in the case of minors, also from their parents or legal guardians, as appropriate.  The only exception being images provided by Iowa Wesleyan University for the purpose of publication on the Voices of IW Site.
  • User Submissions should relate to the content on the Voices of IW Site and should be intended to add to the discussion and community on the Voices of IW Site. 
  • User Submissions must be respectful of others. Epithets or other language or material intended to intimidate or to incite violence are strictly prohibited.  Your User Submission may not include any negative comments that are connected to or seem to be connected to race, national origin, gender, sexual orientation, or physical or mental handicap or that are defamatory, slanderous, indecent, obscene, pornographic, or sexually explicit. 
  • User Submissions may not contain any commercial material.  You may not solicit funds, promote commercial entities, or otherwise engage in commercial activity through your User Submission.  Soliciting other users to join or become members of any commercial online service or other organization is expressly prohibited. 
  • Do not impersonate any other person or entity or falsely state or otherwise misrepresent your affiliation with any person or entity. 
  • Remember that the Voices of IW Site is public.  Do not post personal information (e.g. password, phone number, address, email address, or other personally identifiable information or contact information) in these areas.  All User Submissions must comply with these rules and any additional guidelines posted on the Site, as applicable.  
  • User Submissions do not represent the views of Iowa Wesleyan University or any individual associated with Iowa Wesleyan University, and we do not control this content. In no event shall you represent or suggest, directly or indirectly, Iowa Wesleyan University’s endorsement of User Submissions.  Iowa Wesleyan University does not vouch for the accuracy or credibility of any User Submissions and does not take any responsibility or assume any liability for any actions you may take as a result of reading User Submissions on the Voices of IW Site.  
  • Through your use of the Voices of IW Site, you may be exposed to Content and User Submissions that you may find offensive, objectionable, harmful, inaccurate, or deceptive.  There may also be risks of dealing with underage persons, people acting under false pretense, international trade issues, and foreign nationals.  By using the Voices of IW Site, you assume all associated risks.

  1. Changes to these terms and conditions of use

Please note that we may change these terms and conditions from time to time at our sole discretion and we reserve the right to do without your consent.  Any revised terms and conditions will be applicable at the time of posting on the Voices of IW Site.  Please ensure that you review these terms and conditions regularly as you will be deemed to have accepted a variation if you continue to use the Voices of IW Site after it has been posted.

  1. Indemnification

You agree to defend, indemnify and hold Voices of IW, its parent companies, subsidiaries, affiliates, successors, directors, officers, employees, service providers, and agents from any and all liabilities, costs, and expenses, including reasonable attorneys’ fees, related to any violation of these terms by you, or in connection with the use of the Voices of IW Site or the Internet or the placement or transmission of any message or information on the Voices of IW Site by you.  If you registered as a member of the Voices of IW Site, you are entirely responsible for any and all activities that occur under your account and agree to indemnify, defend, and hold harmless the above-mentioned parties for any liability or expense arising from such use or misuse.  You agree to immediately notify us of any unauthorized use of your account or any other breach of security known to you at voices@iw.edu.

  1. DMCA notice for US users

If you are a US copyright owner or an agent of a US copyright owner and believe that any User Submissions or other content on the Voices of IW Site infringes upon your copyrights, you may submit a notification pursuant to Title 17, United States Code, Section 512(c)(3), the Digital Millennium Copyright Act (“DMCA”) by providing the following information in writing:

(i) identification of the copyrighted work or works claimed to have been infringed;

(ii) identification of the material that is claimed to be infringing and information reasonably sufficient to permit us to locate the material;

(iii) your contact information including your name, an address, telephone number, and, if available, an email address;

(iv) a statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the owner of the work, its agent, or the law;

(v) a statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; and

(vi) your physical or electronic signature;

Please submit the proper documentation to voices@iw.edu with “DMCA notice” in the subject line.  You acknowledge that if you fail to comply with all of the requirements of this Section, your DMCA notice may not be valid.

  1. Additional disclaimers

Visitors to the Voices of IW Site agree that their use of the Voices of IW Site is at their own sole risk.  The Voices of IW Site is provided “as is” and “as available,” without warranty of any kind, either express or implied including but not limited to: (i) any warranties concerning the availability, accuracy, appropriateness, reliability, timeliness, or usefulness of the content of the Voices of IW Site; and (ii) any warranties of title, warranty of non-infringement, or warranties of merchantability or fitness for a particular purpose.  In some instances, content made available on the Voices of IW Site may represent the opinions and judgments of providers or users, such as User Submissions.  Voices of IW and its affiliates do not endorse nor shall they be responsible or liable for the accuracy or reliability of any statement made on the Voices of IW Site by anyone other than authorized Voices of IW employees, faculty, staff, or affiliates acting in such capacity.

This disclaimer of liability applies to any damages or injuries caused by the Voices of IW Site, including, without limitation, those damages or injuries occurring as a result of: (i) any error, omission, deletion, or defect in the content available on the Voices of IW Site; or (ii) any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, computer virus, communication line failure, theft or destruction of records, information or data, unauthorized access to, alteration of, or use of records, information or data, whether for breach of contract, tort, negligence, defamation, or any other cause of action.  Voices of IW do not warrant or guarantee that access to the Voices of IW Site will be uninterrupted or error-free.

Applicable law may not allow the exclusion of implied warranties, so the above exclusion may not apply to you.

  1. Limitation of liability

YOU ACKNOWLEDGE AND AGREE THAT, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, REGARDLESS OF THE FORM OF ACTION, WHETHER IN CONTRACT, TORT (INCLUDING NEGLIGENCE) OR OTHERWISE, IN NO EVENT WILL IOWA WESLEYAN UNIVERSITY OR ITS AFFILIATES, INCLUDING, WITHOUT LIMITATION, THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, SUCCESSORS AND ASSIGNS, BE LIABLE TO YOU OR ANY OTHER PARTY FOR ANY DIRECT OR INDIRECT LOSS, DAMAGE, COST, EXPENSE, OR LIABILITY OF ANY KIND (“LOSS”) ARISING IN ANY WAY OUT OF OR IN CONNECTION WITH THE AVAILABILITY, USE, RELIANCE ON, OR INABILITY TO USE THE VOICES OF IW SITE, INCLUDING (WITHOUT LIMITATION): (i) DAMAGES FOR BUSINESS INTERRUPTION, LOSS OF BUSINESS AND OTHER PROFITS, LOSS OF PROGRAMS, COST OF REPLACING EQUIPMENT OR SOFTWARE OR LOSS OF RECORDS, INFORMATION OR DATA, LOSS OF USE OF DATA, LOSS OF REVENUE, LOSS OF GOODWILL, LOSS OF CUSTOMERS, LOSS OF OR DAMAGE TO REPUTATION, LOSS OF CAPITAL, DOWNTIME COSTS, LOSS UNDER OR IN RELATION TO ANY OTHER CONTRACT, OR LOSS OF ANTICIPATED SAVINGS OR BENEFITS; (ii) ANY INDIRECT, SPECIAL, EXEMPLARY, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL LOSS; OR (iii) ANY LOSS ATTRIBUTABLE TO ERRORS, OMISSIONS, OR OTHER INACCURACIES IN THE VOICES OF IW SITE. THE EXCLUSION OF LIABILITY IN THIS SECTION 11 APPLIES EVEN IF IOWA WESLEYAN UNIVERSITY SHALL HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH LOSS.

BECAUSE SOME STATES OR JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF LIABILITY FOR PARTICULAR KINDS OF LOSS, IN SUCH STATES OR JURISDICTIONS, IOWA WESLEYAN UNIVERSITY’S LIABILITY SHALL BE LIMITED TO THE EXTENT PERMITTED BY LAW (THEREBY MINIMIZING IW’S LIABILITY TO YOU TO THE LOWEST AMOUNT THAT APPLICABLE LAW PERMITS).
